ZIGChain Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the ZIGChain blockchain network, related websites (including the ZIGChain website, ZIGChain Hub, ZIGChain Snapshots, and ZIGChain Faucet), software, interfaces, applications, documentation, developer tools, APIs, smart contracts, validator services, and any related products, features, content, and services made available by or on behalf of ZIGChain Foundation or its designated affiliates from time to time (collectively, the “ZIGChain Ecosystem”).
Please read these Terms carefully. By accessing, using, interacting with, or otherwise participating in any part of the ZIGChain Ecosystem, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not access or use the ZIGChain Ecosystem.
1. Important Notices
1.1 No Investment Offering; Technology Access Only
ZIGChain is a Layer 1 blockchain infrastructure project focused on enabling public blockchain-based wealth generation infrastructure, including infrastructure for tokenization, decentralized applications, validator participation, network utility, and other technology-enabled financial use cases. The ZIGChain Ecosystem is made available as technology infrastructure and related services only. Nothing in the ZIGChain Ecosystem constitutes or shall be construed as:
(a) an offer, solicitation, recommendation, endorsement, or invitation to buy, sell, subscribe for, or hold any security, financial instrument, derivative, collective investment product, fund interest, deposit, loan product, or regulated financial product;
(b) investment advice, financial advice, legal advice, tax advice, fiduciary advice, brokerage services, exchange services, payment services, custody services, or regulated virtual asset services, unless expressly stated in a separate written agreement by a properly licensed entity; or
(c) a promise, representation, or guarantee that any person will generate profit, income, yield, or wealth by using the ZIGChain Ecosystem.
1.2 Experimental Technology
Blockchain networks, smart contracts, cryptographic systems, tokenization structures, decentralized governance, wallets, validators, bridges, oracles, AI-enabled tools, and related infrastructure are inherently experimental and may be subject to bugs, hacks, exploits, cyberattacks, outages, forks, congestion, design flaws, governance failures, interoperability failures, regulatory changes, or other failures that may result in partial or total loss of digital assets, data, access credentials, utility, or expected functionality.
1.3 Assumption of Risk
You acknowledge and accept all risks associated with the use of the ZIGChain Ecosystem, including the risk of loss of digital assets, private keys, access credentials, data, commercial opportunities, or network participation rights, whether temporary or permanent.
1.4 No Fiduciary Duties
To the maximum extent permitted by applicable law, neither ZIGChain Foundation nor any related person owes any fiduciary duty, advisory duty, suitability duty, best execution duty, or similar duty to you by virtue of your use of the ZIGChain Ecosystem.
2. Definitions
For purposes of these Terms:
“Foundation” means ZIGChain Foundation, a Cayman Islands foundation company, and its permitted successors and assigns.
“Digital Assets” means any blockchain-based tokens, coins, cryptocurrencies, stablecoins, tokenized assets, NFTs, governance tokens, utility tokens, or similar digital representations of value or rights.
“Protocol” means the decentralized Layer 1 blockchain network known as ZIGChain, including its consensus rules, smart contract environment, validator framework, transaction logic, and related open-source or proprietary components.
“ RWA” means Real World Assets, or the tokenized representation thereof, including on-chain representations of off-chain rights or entitlements.
“Services” means any websites, interfaces, dashboards, APIs, developer resources, software, educational materials, community resources, or other services made available by or on behalf of the Foundation in connection with the Protocol.
“ZIG Token” means the native blockchain token intended for network utility, including payment of gas fees, staking, validator-related participation, governance-related utility where applicable, and other protocol-native functions as may be enabled from time to time.
“User,” “you,” or “your” means any individual or entity that accesses or uses the ZIGChain Ecosystem.
3. Eligibility
You may use the ZIGChain Ecosystem only if:
(a) you are at least 18 years old, or the age of legal majority in your jurisdiction, whichever is higher;
(b) you have full legal capacity, power, and authority to enter into these Terms;
(c) you are not located in, organized in, resident in, or ordinarily resident in any Restricted Jurisdiction;
(d) you are not a Sanctioned Person and are not acting on behalf of or for the benefit of a Sanctioned Person;
(e) your access to and use of the ZIGChain Ecosystem is not prohibited by applicable law; and
(f) where you act on behalf of an entity, you have authority to bind that entity to these Terms.
You represent and warrant on a continuing basis that the foregoing statements remain true, accurate, and complete.
4. Restricted Jurisdictions and Sanctions Compliance
4.1 Restricted Jurisdictions
The ZIGChain Ecosystem, or certain parts of it, may not be available to persons located in, incorporated in, resident in, or otherwise subject to the laws of jurisdictions that are embargoed, sanctioned, prohibited, or otherwise designated by the Foundation from time to time as restricted, including jurisdictions subject to comprehensive sanctions or trade restrictions.
4.2 Sanctioned Persons
You may not use the ZIGChain Ecosystem if you are:
(a) listed on any sanctions list maintained by OFAC, the United Nations, the European Union, His Majesty’s Treasury, or similar authorities;
(b) directly or indirectly owned or controlled by a Sanctioned Person; or
(c) acting on behalf of, or for the benefit of, any Sanctioned Person or person in a Restricted Jurisdiction.
4.3 Compliance Measures
The Foundation may implement geo-blocking, wallet screening, transaction monitoring, onboarding controls, access controls, or other compliance measures at any time. The Foundation may suspend, restrict, or terminate access where necessary or appropriate to comply with applicable law, sanctions obligations, or internal risk controls.
5. Nature of the ZIG Token; Token-Specific Disclaimers
5.1 Utility and Gas Token Only
The ZIG Token is intended solely as a native utility token of the Protocol. Its primary intended functions may include payment of gas fees, validator and staking-related utility, governance-related utility where enabled, access to protocol functions, network incentives, and other non-investment consumptive uses within the ZIGChain Ecosystem.
The ZIG Token is not intended to be, and should not be purchased, acquired, held, or used as:
(a) a share, equity interest, ownership interest, partnership interest, or other security;
(b) a bond, note, debenture, loan participation, or other debt instrument;
(c) a unit in a collective investment scheme, fund, or pooled investment arrangement;
(d) a derivative, option, future, contract for differences, or synthetic exposure instrument;
(e) a claim on the Foundation’s assets, revenues, profits, and treasury, or governance bodies; or
(f) a right to guaranteed returns, income, profit-sharing, dividends, redemption rights, or repayment obligations.
5.2 No Expectation of Profit from Foundation Efforts
No statement in the ZIGChain Ecosystem should be interpreted as creating or encouraging an expectation of profit derived primarily from the managerial or entrepreneurial efforts of the Foundation or any third party. Any increase or decrease in the value of any Digital Asset, including the ZIG Token, may result from numerous factors beyond the Foundation’s control.
5.3 No Rights Against the Foundation
Except where expressly stated in mandatory applicable law or a separate written agreement signed by an authorized representative of the Foundation, holding or using ZIG Tokens does not grant you any equity rights, creditor rights, repayment rights, revenue share rights, profit participation rights, liquidation rights, intellectual property rights, governance veto rights, information rights, or rights against the Foundation.
5.4 Token Value and Volatility Risk
The ZIG Token and any other Digital Assets accessible through the ZIGChain Ecosystem may be highly volatile and may lose some or all of their value at any time. You acknowledge that token prices may fluctuate materially due to market conditions, liquidity constraints, speculative activity, network incidents, cybersecurity events, third-party conduct, regulatory developments, exchange delistings, token unlocks, macroeconomic factors, governance changes, forks, or reputational events.
5.5 Permanent Loss Risk
Transactions involving Digital Assets are generally irreversible. Errors, exploits, private key compromise, phishing, malware, user mistakes, validator errors, smart contract defects, bridge incidents, wallet failures, or sending assets to the wrong address may result in permanent and unrecoverable loss.
5.6 Token Documentation
Any white paper, lite paper, token information page, FAQ, blog post, roadmap, governance material, or technical documentation is provided for informational purposes only and does not form part of these Terms unless expressly incorporated by reference.
5.7. User Intent and Consumptive Use
You represent, warrant, and covenant that your acquisition, holding, or use of the ZIG Token is and will remain solely for the purpose of utilizing the ZIGChain Protocol and related network utility, including the payment of gas fees and participation in protocol functions, and is not for any investment, speculative, or profit-seeking purpose. You agree that the ZIG Token’s value, if any, is derived from its consumptive utility within the Protocol and not from the managerial or entrepreneurial efforts of the Foundation.
6. Wealth Generation Disclaimer
ZIGChain’s mission includes building “wealth generation infrastructure for everyone.” This description reflects the Protocol’s technology vision and intended utility as open infrastructure. It does not mean, imply, or guarantee that:
(a) any user will earn profits, returns, yield, or passive income;
(b) any protocol, decentralized application, validator, vault, strategy, tokenized asset, or third-party service deployed on or connected to ZIGChain is suitable, lawful, profitable, secure, or risk-free;
(c) any on-chain or off-chain opportunity will preserve capital or outperform any benchmark; or
(d) participation in the ZIGChain Ecosystem is appropriate for your financial circumstances, investment objectives, risk tolerance, or legal status.
You are solely responsible for evaluating the economic merits and legal consequences of any activity conducted on or in connection with the Protocol.
7. User Responsibilities
You are solely responsible for:
(a) your use of the ZIGChain Ecosystem;
(b) compliance with all laws, regulations, tax rules, sanctions restrictions, and reporting obligations applicable to you;
(c) maintaining the confidentiality and security of your wallets, seed phrases, private keys, passwords, API credentials, devices, and authentication tools;
(d) verifying transaction details before submission;
(e) obtaining your own legal, tax, accounting, cybersecurity, and financial advice;
(f) evaluating the legitimacy, suitability, and risk of any third-party application, protocol, tokenized asset, validator, RWA product, bridge, wallet, custody solution, oracle, AI tool, or smart contract; and
(g) ensuring that any content, data, materials, or transactions you submit or initiate do not violate applicable law or third-party rights.
8. Privacy and Data Protection
8.1 Data Controller
For the purposes of the Cayman Islands Data Protection Act (the “DPA”) and, where applicable, the General Data Protection Regulation (“GDPR”), the Foundation acts as a data controller or processor (as applicable) regarding the personal data it collects through its centralized Services.
8.2 Collection and Processing
The Foundation processes personal data in accordance with the DPA. By using the ZIGChain Ecosystem, you acknowledge that your personal data may be collected, processed, and transferred for the purposes of operating the Services, ensuring compliance with legal and regulatory obligations (including KYC/AML where applicable), and maintaining the security of the ecosystem.
8.3 Nature of Blockchain Data
You acknowledge that the ZIGChain Protocol is a decentralized, public blockchain. Data recorded on the blockchain (such as transaction history, wallet addresses, and public keys) is immutable and publicly accessible globally. Such data may not be subject to rights of deletion, rectification, or restriction under the DPA or other privacy laws once recorded. You should not submit personal data to the blockchain unless you fully understand and accept these limitations.
8.4 International Transfers
The Foundation may transfer personal data to jurisdictions outside the Cayman Islands where data protection standards may differ. The Foundation will take reasonable steps to ensure that any such transfer is conducted in compliance with the DPA and other applicable laws, maintaining appropriate safeguards for the protection of your data.
8.5 Your Rights
Subject to the limitations of the DPA and the technical constraints of decentralized technology, you may have rights to access, correct, or object to the processing of your personal data held by the Foundation. Please contact the Foundation's designated legal representative if you have inquiries regarding your personal data.
9. Technology-Agnostic and Innovation Disclaimer
ZIGChain may support, integrate with, or reference emerging technologies including blockchain, tokenization, AI systems, automated agents, cloud services, zero-knowledge systems, interoperability solutions, advanced cryptography, and technologies described as quantum-ready or quantum-resistant. Such references do not constitute a warranty of future compatibility, security, legal permissibility, merchantability, operational fitness, or uninterrupted availability.
The Foundation may modify, discontinue, replace, or deprioritize any technical feature, roadmap item, integration, or technology direction at any time, with or without notice.
10. RWA Tokenization and Third-Party Protocol Disclaimer
The Protocol may be used by third parties for the tokenization of real world assets, on-chain representations of off-chain rights, wealth management tools, staking solutions, vaults, lending structures, or other financial and quasi-financial use cases. The Foundation does not independently verify, endorse, guarantee, or assume liability for:
10.1 Specific Service Disclaimers
The following specific disclaimers apply to individual components of the ZIGChain Ecosystem:
ZIGChain Hub: The Hub is a non-custodial interface. Users acknowledge that staking involves inherent risks, including slashing, unbonding periods, and reward fluctuations. Interactions with third-party cross-chain bridges involve risks such as smart contract vulnerabilities and potential loss of funds.
ZIGChain Snapshots and Faucet: These services are provided for informational and utility purposes only, are experimental in nature, and are subject to availability and service interruptions:
- the legal enforceability, ownership validity, bankruptcy remoteness, true-sale character, segregation, perfection, or transferability of any tokenized or referenced asset;
- the compliance status of any issuer, arranger, originator, custodian, trustee, servicer, broker, fund manager, SPV, or platform;
- the valuation, disclosures, underlying reserves, collateral sufficiency, redemption rights, or risk profile of any tokenized asset or RWA structure; or
- the truth, accuracy, completeness, or legality of any third-party materials or representations.
Any use of the Protocol in connection with RWAs or wealth generation products is at your sole risk and subject to your own diligence.
The Foundation acts solely as the provider of the underlying Layer 1 blockchain infrastructure, and expressly disclaims any role as an originator, arranger, issuer, underwriter, trustee, servicer, custodian, or administrator with respect to any RWA Tokenization. The availability of the Protocol for RWA use cases does not constitute any representation by the Foundation that such RWA Tokenization complies with the laws of any jurisdiction, including securities, banking, or financial services laws.
11. Open Network; No Ongoing Duty to Support
The Protocol may include open-source or community-driven components and may evolve through governance, validator participation, software upgrades, forks, or ecosystem development. The Foundation does not undertake any obligation to continue developing, maintaining, operating, supporting, hosting, or promoting any part of the ZIGChain Ecosystem.
The Foundation may, at any time and without liability, modify, suspend, restrict, remove, or discontinue any Service, feature, website, interface, documentation set, API, software tool, or support channel.
12. No Custody; No Intermediation
Unless expressly stated in a separate written agreement by a duly licensed entity, the Foundation does not provide custody, brokerage, exchange, payment, escrow, trustee, nominee, discretionary management, or fiduciary services. You retain sole control and responsibility over your wallets, transactions, keys, and Digital Assets.
Where third-party wallet providers, custodians, exchanges, staking providers, validators, or service providers are used in connection with the ZIGChain Ecosystem, those services are provided by third parties and governed solely by their own terms.
13. Fees and Gas
Use of the Protocol may require payment of gas fees, transaction fees, validator fees, service fees, third-party fees, or similar costs. You are solely responsible for all such fees, together with any taxes, duties, levies, or charges arising in connection with your activities.
The Foundation does not guarantee fee levels, transaction ordering, confirmation speed, or network throughput.
14. Prohibited Conduct
You must not, and must not attempt to, directly or indirectly:
(a) violate any applicable law, regulation, sanctions rule, or court order;
(b) infringe or misappropriate any intellectual property right or other third-party right;
(c) use the ZIGChain Ecosystem to facilitate money laundering, terrorist financing, sanctions evasion, fraud, market manipulation, illegal gambling, unlawful surveillance, ransomware activity, theft, or any unlawful activity;
(d) upload, deploy, transmit, or facilitate malware, spyware, viruses, malicious code, exploits, or harmful scripts;
(e) interfere with, disrupt, overload, attack, or attempt unauthorized access to the Protocol, validators, nodes, APIs, websites, or related infrastructure;
(f) misrepresent your identity, affiliation, authority, location, compliance status, or the nature of any asset, transaction, or protocol;
(g) use the ZIGChain Ecosystem in a manner that could expose the Foundation or the ecosystem to regulatory, sanctions, cybersecurity, or reputational risk;
(h) scrape, mirror, harvest, or data-mine the Services in an abusive or unauthorized manner; or
(i) encourage, assist, or enable any other person to do any of the foregoing.
15. Compliance, Monitoring, and Enforcement
The Foundation may, to the extent legally permitted and technically feasible, monitor usage of hosted Services, screen wallets or addresses, investigate suspected misconduct, cooperate with regulators or law enforcement, and take any action it deems reasonably necessary to protect the Protocol, the Services, users, or the Foundation.
Such actions may include refusal of access, suspension, geo-blocking, wallet blocking in hosted interfaces, removal of content, reporting to competent authorities, or disclosure of information as required by law or reasonably necessary to enforce these Terms.
16. Intellectual Property
Subject to your compliance with these Terms, the Foundation grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable right to access and use the Services for lawful purposes.
Except for open-source software expressly licensed under separate open-source terms, all content, branding, names, logos, website materials, documentation, software elements, graphics, design, and other materials made available by or on behalf of the Foundation are owned by or licensed to the Foundation and are protected by applicable intellectual property laws.
No rights are granted except as expressly set forth in these Terms.
17. Open-Source Components
Certain components of the ZIGChain Ecosystem may be made available under open-source licenses. Your use of such components is subject to the applicable open-source license terms, which shall govern in the event of conflict with these Terms solely with respect to the relevant open-source component.
18. Third-Party Services and Content
The ZIGChain Ecosystem may link to, integrate with, or make accessible third-party websites, wallets, custodians, exchanges, validators, node operators, AI tools, tokenization platforms, DeFi applications, bridges, oracles, cloud providers, analytics providers, and other services. The Foundation neither controls nor endorses such third-party services and disclaims all responsibility and liability for them.
Your dealings with third parties are solely between you and such third parties.
19. No Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE ZIGCHAIN ECOSYSTEM IS PROVIDED ON AN “AS IS,” “WHERE IS,” AND “AS AVAILABLE” BASIS, WITH ALL FAULTS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
WITHOUT LIMITING THE FOREGOING, THE FOUNDATION DISCLAIMS ALL WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, ACCURACY, COMPLETENESS, SECURITY, RELIABILITY, INTEROPERABILITY, PERFORMANCE, UPTIME, CONTINUITY, OR FREEDOM FROM VIRUSES, BUGS, DEFECTS, OR MALICIOUS CODE.
THE FOUNDATION DOES NOT WARRANT THAT THE PROTOCOL, ANY SMART CONTRACT, ANY DIGITAL ASSET, ANY WEBSITE, ANY INTERFACE, ANY VALIDATOR SET, ANY TRANSACTION, ANY TOKENIZATION STRUCTURE, ANY RWA DEPLOYMENT, ANY AI-ENABLED FEATURE, OR ANY RELATED TECHNOLOGY WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, TIMELY, LAWFUL, OR FREE FROM LOSS, FORK, FAILURE, ATTACK, OR UNINTENDED OUTCOME.
20. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE FOUNDATION OR ANY OF ITS OFFICERS, DIRECTORS, COUNCIL MEMBERS, SUPERVISORS, EMPLOYEES, CONTRACTORS, ADVISERS, DEVELOPERS, CONTRIBUTORS, AGENTS, REPRESENTATIVES, LICENSORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, OPPORTUNITY, GOODWILL, DATA, USE, REPUTATION, OR DIGITAL ASSETS, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE ZIGCHAIN ECOSYSTEM, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, STATUTE, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE AGGREGATE LIABILITY OF THE FOUNDATION AND ITS RELATED PERSONS ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE ZIGCHAIN ECOSYSTEM SHALL NOT EXCEED THE GREATER OF: (A) USD 100; AND (B) THE AMOUNT, IF ANY, PAID BY YOU DIRECTLY TO THE FOUNDATION FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
NOTHING IN THESE TERMS SHALL EXCLUDE OR LIMIT LIABILITY TO THE EXTENT SUCH LIABILITY CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
21. Indemnity
You shall defend, indemnify, and hold harmless the Foundation and its officers, directors, council members, supervisors, employees, contractors, advisers, contributors, agents, licensors, and affiliates from and against any and all claims, actions, proceedings, investigations, liabilities, damages, losses, judgments, settlements, penalties, fines, costs, and expenses (including reasonable legal fees) (collectively, “Losses”), including Losses arising from or related to any governmental or regulatory enforcement action, arising out of or related to:
(a) your access to or use of the ZIGChain Ecosystem;
(b) your breach of these Terms;
(c) your violation of applicable law or third-party rights;
(d) any Digital Asset, application, protocol, asset tokenization structure, interface, content, or transaction submitted, launched, deployed, transmitted, or facilitated by you; or
(e) any fraud, negligence, misconduct, or misrepresentation by you.
22. Suspension and Termination
The Foundation may, at any time and in its sole discretion, suspend, restrict, disable, or terminate your access to any hosted or controlled part of the ZIGChain Ecosystem, with or without notice, if:
(a) it believes you have breached these Terms;
(b) it is required to do so by law, court order, regulator, sanctions authority, or governmental request;
(c) your use presents legal, technical, cybersecurity, operational, or reputational risk; or
(d) the Foundation elects to discontinue the relevant Service.
Termination or suspension shall not limit any rights or remedies available to the Foundation.
23. Disclaimers Regarding Tax, Legal, and Regulatory Treatment
The legal, tax, accounting, and regulatory treatment of Digital Assets, tokenization structures, staking, validator rewards, governance participation, protocol fees, RWA structures, and blockchain activity is uncertain and may vary across jurisdictions. You are solely responsible for determining what laws apply to you and for paying any taxes or duties arising from your activities.
The Foundation is not responsible for any adverse tax or legal consequences resulting from your use of the ZIGChain Ecosystem.
24. Forward-Looking Statements
Any statement regarding future plans, protocol development, roadmap items, ecosystem growth, token utility, technological readiness, governance evolution, AI integration, quantum readiness, RWA adoption, or prospective features is forward-looking in nature and subject to substantial uncertainty. The Foundation undertakes no obligation to update such statements.
25. Dispute Resolution and Governing Law
These Terms, and any non-contractual obligations arising out of or in connection with them, shall be governed by the laws of the Cayman Islands, excluding its conflict of laws principles.
Any dispute, controversy, difference, or claim arising out of or in connection with these Terms, including any question regarding their existence, validity, interpretation, performance, breach, or termination, shall be referred to and finally resolved by arbitration under the Rules of the London Court of International Arbitration (LCIA), which Rules are deemed incorporated by reference into this clause.
The seat of arbitration shall be London, England.
The tribunal shall consist of one (1) arbitrator.
The language of the arbitration shall be English.
The arbitral award shall be final and binding on the parties, and judgment upon the award may be entered and enforced in any court of competent jurisdiction.
Notwithstanding the foregoing, the Foundation may seek interim, conservatory, injunctive, or equitable relief in any court of competent jurisdiction where necessary to protect its rights, confidential information, intellectual property, systems, or compliance position.
26. Class Action Waiver
To the extent permitted by applicable law, you agree that any dispute shall be brought solely in your individual capacity and not as a plaintiff or class member in any purported class, collective, representative, or mass action.
27. Force Majeure
The Foundation shall not be liable for any delay, failure, interruption, or impairment in performance resulting from events beyond its reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, pandemics, cyberattacks, denial-of-service events, internet outages, blockchain failures, software exploits, failures of third-party service providers, governmental actions, sanctions, utility failures, or market disruptions.
28. Changes to These Terms
The Foundation may amend or update these Terms from time to time. Updated Terms may be posted on the relevant website or otherwise made available through the Services. Your continued use of the ZIGChain Ecosystem after updated Terms become effective constitutes your acceptance of the updated Terms.
If applicable law requires notice or consent for certain changes, the Foundation will use commercially reasonable efforts to provide such notice in an appropriate manner.
29. Assignment
You may not assign, transfer, delegate, or novate any of your rights or obligations under these Terms without the Foundation’s prior written consent. The Foundation may assign, transfer, or novate these Terms, in whole or in part, to any affiliate or successor without restriction.
30. Entire Agreement
These Terms, together with any policies or documents expressly incorporated by reference, constitute the entire agreement between you and the Foundation regarding the subject matter hereof and supersede all prior or contemporaneous understandings relating to such subject matter.
31. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid, illegal, or unenforceable provision shall be deemed modified to the minimum extent necessary to make it enforceable while preserving its intent as closely as possible.
32. No Waiver
No failure or delay by the Foundation in exercising any right, power, or remedy under these Terms shall operate as a waiver thereof.
